This software product is (C)1996-2007 Copyright A Custom Computer Solution -Brian Harrell It will operate 30 days with 100% functionality except for the limit on importing 1500 songs into the database unless you order the registration key via the web or the order form via Help menu in the program. Purpose: The purpose of the program is to make it easy for you to enter your song titles and artists for your music collection into a very easy-to-search database with custom printouts. It can get the titles from your CD's using an internet connection to the CDDB database. Minimum Requirements:16 RAM 10 MB hard drive space 486 dx66 or higher and Windows 95/98/2000 required. LICENSE INFORMATION: If you do not agree to the following license for this software--please press CANCEL. This is a legal agreement between you the end user and A Custom Computer Solution. The enclosed software program Music Database 2000 (hereafter "MDB2000") (C) copyright 1996-2000 A Custom Computer Solution (hereafter "ACCSI") and is for use only on the terms and conditions of this agreement (collectively hereafter "Agreement"). GRANT OF LICENSE ACCSI grants you the end user the right to use one copy of the software program MDB2000 on a single terminal connected to a single computer. ACCSI does not guarantee that CDDB Internet access will be available forever as that is a third party software agreement with ACCSI. If you install MDB2000 on a network server, you must purchase a copy of MDB2000 for each computer terminal that will be used to operate MDB2000. If you purchased a multiple user license for the use of MDB2000, you may make as many copies of MDB2000 as to the number of licenses you purchased (100 user license allows you to install MDB2000 on a maximum of 100 computer terminals). TERM OF LICENSE Multiple User License (Site License) holders are granted a two year term of use for MDB2000 commencing the date MDB2000 was purchased and ending two years from that date. OWNERSHIP OF SOFTWARE This is a license to use MDB2000 but at no time do you become owner of MDB2000. Ownership and title at all times is retained by ACCSI for the original disks and any copies of MDB2000 irrespective of the media or form in which MDB2000 exists. COPYRIGHT MDB2000 and any accompanying documentation is copyrighted. You are authorized to make one copy of MDB2000 for archival purposes only. You must produce and include all copyright notices in their original form for all copies created irrespective of the media or form in which MDB2000 exists. You may not sub-license , rent, sell, or lease MDB2000. You may not reverse engineer, recompile, disassemble, create derivative works, modify, translate, or make any attempt to discover the source code for MDB2000. LIMITED WARRANTY: ACCSI warrants that the media on which MDB2000 is distributed is free from defects for a period of sixty days from the date of delivery of MDB2000 to you.Your sole remedy for a breach of this warranty will be that ACCSI at it's option may replace the defective media upon receipt of the damaged media, or refund the money you paid for MDB2000. ACCSI does not warrant that MDB2000 will be uninterrupted or error free or that the errors will be corrected. ACCSI does not warrant that MDB2000 will meet your requirements. THE ABOVE WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGMENT. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE. DISCLAIMER OF DAMAGES ACCSI hereby disclaims all warranties for MDB2000, whether expressed or implied. Anyone using, testing, or evaluating MDB2000 bears all risk to the quality and performance of MDB2000. In no event shall ACCSI be liable for any damages of any kind, including without limitation direct, or indirect damages arising out of the use, performance, or delivery of MDB2000 even if ACCSI has been advised of the existence or possibility of such damages. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN NO CASE SHALL ACCSI'S LIABILITY EXCEED THE PURCHASE PRICE FOR MDB2000. The disclaimers and limitations set forth above will apply regardless of whether you accept or use, evaluate or test MDB2000. In the event of invalidity of any provision of this Agreement, the invalidity shall not effect the validity of the remaining portions of this Agreement. U.S. GOVERNMENT RESTRICTED RIGHTS / RESTRICTED RIGHTS LEGEND Use, duplication , or disclosure by the Government is subject to restrictions as set forth in subparagraph (c) (1) (ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c) (1) and (2) of Commercial Computer Software-Restricted Rights clause at 48 CFR 52.227-19, as applicable, ACCI, PO BOX 21145 Eagan MN 55121. GENERAL This Agreement will be governed by the laws of the State of Minnesota, in the United States of America. This Agreement may only be modified by a license addendum which accompanies this license or by a written document which has been signed by both you and ACCSI.
